Upon account setup and activation, the user agrees to be bound by all guidelines outlined in our Acceptable Use Policy.
We reserve the right to refuse, suspend, or terminate service at our sole discretion.
All services provided by JAZ Marketing & Design Inc. must be used solely for lawful purposes. Accounts found to be questionable or in violation of this policy may be terminated without warning. Users are responsible for requesting approval if they are unsure whether their content is acceptable.
Prohibited content includes, but is not limited to:
JAZ Marketing & Design Inc. will be the sole arbiter of what constitutes a content violation. All users agree to indemnify and hold JAZ Marketing & Design Inc. harmless for any claims or actions arising from their content or actions on our system.
The sending of unsolicited emails (spam) is strictly prohibited on JAZ Marketing & Design Inc. servers. Users are responsible for all email addresses associated with their account and for all emails sent from their domain. Accounts violating this policy may be terminated immediately without warning.
Users are responsible for maintaining current backups of their files. While JAZ Marketing & Design Inc. conducts routine system backups and may assist with data restoration, we are not responsible for lost files or data. Users agree to hold JAZ Marketing & Design Inc. harmless for any loss of data.
Hosting accounts are automatically renewed for an additional term on the contract due date. To cancel, you must contact our office at least 30 days before the next billing date to avoid automatic renewal. There is no cancellation fee; however, refunds for unused time after billing will not be provided.
Failure to comply with any terms or conditions may result in immediate account termination. No refunds are guaranteed, and any refund issued is solely at the discretion of JAZ Marketing & Design Inc.
JAZ Marketing & Design Inc. shall not be liable for any damages, including incidental or consequential damages, resulting from server downtime or service unavailability. We make no warranties, express or implied, regarding the services we provide, including merchantability or fitness for a particular purpose. This includes data loss, delayed delivery, or service interruptions.
Clients agree to indemnify JAZ Marketing & Design Inc. for violations of law or policy that result in loss or claims against the company. In the event of legal action resulting from a client’s activities, the client agrees to cover damages, costs, and reasonable attorney fees. JAZ Marketing & Design Inc. is the sole arbiter of policy violations.

All clients must be at least 18 years of age to obtain services. JAZ Marketing & Design Inc. may update the Acceptable Use Policy or hosting configurations without prior notice. Non-enforcement of any policy does not constitute consent. Violations should be reported immediately; all complaints will be investigated promptly.
This agreement is governed by the laws of the Province of Ontario, without regard to conflicts of law provisions. Both JAZ Marketing & Design Inc. and the client knowingly waive the right to a jury trial for any claims arising from this agreement or related documents.
This agreement supersedes all prior communications, whether written, oral, or implied, and constitutes the full and complete agreement between the parties.
